The Alberta Energy Regulator updates Directives 088 and 067 to force operators to prove financial health and cover environmental cleanup costs

Alberta is tired of being left with the bill. For years, the province has wrestled with the growing ghost of inactive oil wells and the financial wreckage left behind by insolvent operators. In a bid to stop the bleeding, the Alberta Energy Regulator has overhauled Directives 067 and 088. These updates shift the burden of proof back onto the industry, requiring companies to demonstrate they are financially fit before they ever break ground.

The new framework moves away from narrow checklists in favor of a holistic assessment of a company’s health. Regulators will now scrutinize a firm’s entire history and its current bank balance before granting or transferring licenses. This change is designed to weed out bad actors who might otherwise walk away from their environmental liabilities. It is a tough love approach that prioritizes long-term stability over short-term growth.

For the energy and logistics sectors, the message is clear. If you want to play in Alberta, you must be prepared to pay for the cleanup. While the higher bar for entry might frustrate some smaller players, it provides much-needed certainty for the rest of the market. Responsible operators are no longer forced to compete on an uneven playing field against those who cut corners on reclamation.

This regulatory shift is about more than just paperwork. It is an attempt to restore public trust in an industry that remains the backbone of the provincial economy. By ensuring that corporations internalize the costs of their exit strategies, Alberta is protecting taxpayers from future cleanup costs. It is a pragmatic evolution that balances industrial ambition with the stark reality of environmental debt. Only 10 percent of the battle is setting the rules, while the rest lies in consistent enforcement.
